The Baltic and International Maritime Council (BIMCO) has adopted two critical contractual solutions designed to assist shipowners and operators in navigating pressing operational and regulatory challenges. The revised RECYCLECON contract and the Energy Saving Device Retrofit Addendum 2026 were ratified during an online meeting held on 8 October, reflecting the industry’s shifting priorities towards sustainability and compliance.
REVISED RECYCLECON CONTRACT
The RECYCLECON contract has been modernized to provide a comprehensive legal framework for the safe and environmentally sound recycling of vessels. This revision places emphasis on aligning with the principles set out in the Hong Kong International Convention for the Safe and Environmentally Sound Recycling of Ships. As a significant number of vessels are anticipated to reach the end of their operational lives in the coming years, the updated contract facilitates clearer commercial and documentary arrangements among sellers, buyers, and recycling facilities, thus promoting adherence to environmental standards.

ENERGY SAVING DEVICE RETROFIT ADDENDUM 2026
The Energy Saving Device Retrofit Addendum 2026 is aimed at vessels undergoing retrofitting for energy efficiency. This framework enables shipowners and charterers to mutually agree on the allocation of costs, timeframes, and benefits associated with the installation of energy-saving equipment during a time charter. This flexibility is particularly timely as the industry is increasingly focused on reducing emissions and enhancing operational efficiency through technological upgrades.
In addition to these contracts, BIMCO discussed new clauses to address emerging challenges, including a proposed EU Tanker Sale and Resale Restrictions Clause that reflects the evolving landscape of sanctions affecting tanker sales and operations. The introduction of a clause for the carriage of electric vehicles was also deliberated, acknowledging the growing number of such vehicles being transported by sea, which introduces unique operational and safety considerations.
MODERNIZING INDUSTRY PRACTICES
BIMCO continues to update its HEAVYLIFTVOY charter party to accommodate the specialized requirements of the mid-sized heavy-lift sector. Key revisions are focused on clarifying protocols related to loading and discharge, notice of readiness, laytime, and detentions. This progress is complemented by the development of a new sea waybill to enhance operational flexibility within project cargo transport.
Furthermore, digitalization remains integral to BIMCO’s initiatives. The recent revision of the Electronic Bills of Lading Clause aims to facilitate transitions from paper documentation to electronic systems, enhancing interoperability and efficiency in maritime operations. The proposed Just in Time Arrival and Virtual Notice of Readiness Clause aims to synchronize vessel speeds with port arrival times, reducing both waiting periods and unnecessary fuel consumption.
Behind the Headline
These recent contractual updates from BIMCO represent strategic responses to the maritime industry’s evolving regulatory landscape and operational challenges. By modernizing frameworks for ship recycling and retrofitting, BIMCO aids vessel operators in aligning their operations with environmental regulations while mitigating financial risks associated with retrofitting expenses. The move towards digital documentation and enhanced operational protocols not only indicates a shift toward efficiency but also addresses the industry’s urgent need to respond to safety and compliance demands. Operators should pay close attention to these developments as they hold significant implications for contractual negotiations and operational strategies moving forward.
